Apple Sics Korean Regulator on Samsung

Local media say Apple lodged the complaint in June and that the FTC has completed its initial inquiries

The Korean Fair Trade Commission (FTC) Thursday said it was investigating a complaint made by Apple that Samsung is abusing its dominance in third-generation wireless technology.

The investigation mirrors a similar one opened in January by the European Commission, which is also investigating Motorola Mobility for the same thing.

Both companies are demanding egregiously high fees from Apple to license the standards-essential patents they pledged to offer on fair, reasonable and non-discriminatory (FRAND) terms.

Local media say Apple lodged the complaint in June and that the FTC has completed its initial inquiries.

Samsung issued a statement saying it "has at all times met its obligations to the fair licensing of its telecommunications standards-related patents."

Ironically last month a Korean court ruled that Apple infringed two FRAND-protected Samsung 3G patents and must stop selling some older iPhones and iPads in South Korea.

It decides an injunction based on the infringement of FRAND patents wasn't an abuse of market power, a position US regulators and European courts have rejected. The AP says it was told the Korean regulator would take those rulings into consideration.

The Korean decision was rendered on the same day a California jury found that Samsung should pay Apple $1.05 billion for infringing its patents and copying its iPhone and iPad.
